The Bureau of Pesticides registers all pesticide product brands sold or distributed in Florida and regulates the use of those pesticide products, except where exempted under Chapters 482 and 388, F.S. The Bureau is charged with ensuring that pesticide product brands will not cause unreasonable adverse effects to human health or to the environment.
Pesticide Registration Section
Every pesticide product brand distributed, sold, or offered for sale within this State must be registered with the Department.
The Pesticide Registration Section processes applications for pesticide product brand registrations in accordance with established state and federal regulations and policies to ensure that such registered uses will not adversely impact human health, animal health, or the environment. This process includes requests for the registration of new active ingredients, experimental use permits, special local needs, significant new uses and emergency exemptions when no current registration exists for certain crop/pest combinations. To accomplish this mission, members of this Section consult with specialists within the Department and other state agencies, commissions, boards and councils. Finally, the Section is the central location for basic chemical composition and all general subject matter related to particular pesticide products.

- Is it permissible to sell or distribute pesticides in Florida
without being registered by the Department of Agriculture and Consumer
Services?
No. All pesticide product brands offered for sale in Florida must be registered by the Department. The document: Florida Pesticide Law and Rules, Chapter 487, F.S., provides background information on the distribution and sale of pesticide products in Florida.
- When does a pesticide product brand registration expire?
Each pesticide product brand registration is valid for one or two calendar year(s) depending on the year first registered. All pesticide product brand registrations expire December 31 of an even-calendar year. Each product brand must be renewed by January 31 of the registration year. All renewals received on or after February 1 of the renewing year will be assessed a late fee of $25 per product brand per month with a maximum of $250 per product brand per calendar year. Renewals will not be processed until all applicable late fees are received. See changes to Florida Statute in Chapter 487.041.

- Are "Exempt" pesticides required to be registered in Florida?
Yes. Pesticide products classified as "exempt" under FIFRA Section 25(b) of the Federal Pesticide Law must be registered in Florida. Please request a copy of Florida's written policy on the registration of "exempt" pesticides. The policy is also available on the website of the Florida Department of Agriculture & Consumer Services/Division of Agricultural Environmental Services/Bureau of Pesticides (http://www.flaes.org/pesticide/pesticideregistration.html).
- What must a registrant do if there is a change in the name
of their pesticide product brand and/or EPA product registration
number?
The change in a pesticide product brand name designation and/or a change in the pesticide product brand EPA registration number requires a new application and fee. Each unique combination of pesticide product brand names and EPA product registration numbers must be registered with the State.
- How does a registrant/company make electronic online payments?

- What is the Supplemental Registration Fee?
The Supplemental Registration Fee is assessed on any pesticide product brand containing an active ingredient that has a food residue tolerance as established in 40 Code of Federal Regulations, Part 180. The list of applicable active ingredients is found at: www.flaes.org/pdf/Supplemental_Registration_Fee_Ingredient_List.pdf.
