Laws and Regulations
The Florida Department of Agriculture and Consumer Services (FDACS) is responsible for enforcing all pesticide regulations and laws in Florida — both state and federal. It implements provisions of the Florida Pesticide Law and the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA).
How to File Complaint
In general, it is a violation of state and federal law to use a pesticide inconsistent with label instructions. If you believe pesticides have been used incorrectly, you can file a complaint with FDACS at (850) 617-7996. Please have the following information ready when you contact us:
- The name and contact information of the complainant/victim.
- Name and address of the individual or firm who allegedly misused the pesticide(s).
- Date and time of the incident.
- A description of the incident.
- Name and/or EPA Registration Number of the pesticide(s) involved.
After you contact us by phone, the next phase in the complaint process is to file your complaint in writing. We will supply you with the necessary form to file a written complaint.
FDACS will investigate any complaint that is in writing and is legally sufficient. To determine legal sufficiency, we may require supporting information or documentation.
